Terms of Service
The terms that govern your use of Feedi. Please read them carefully — using the Service means you accept them.
1.Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Daniel Munoz, an independent operator based in Germany, doing business as Feedi (“Feedi”, “we”, “us”), governing your access to and use of the Feedi website, dashboard, APIs, and SDKs (together, the “Service”).
By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
2.Definitions
- Customer (“you”) — the developer or organisation that registers for and uses the Service.
- End User — a user of your application who submits feedback through the SDK.
- Feedback Data — the content and metadata that End Users submit through the SDK.
- Account Data — the data we hold about your Feedi account, such as your email, configuration, and billing records.
- Write Key — the public credential your app uses to submit Feedback Data.
3.Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use by developers and businesses, not consumers.
You are responsible for the security of your account, including the email inbox used for magic-link sign-in, and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You must provide accurate account information and keep it current.
4.The Service and licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service — including the dashboard, APIs, and SDKs — for your internal business purposes and in accordance with our documentation. All rights not expressly granted are reserved.
You may not resell, sublicense, or provide the Service to third parties as a standalone offering, reverse engineer it except to the extent that restriction is prohibited by law, or attempt to circumvent its limits, security, or privacy design.
5.Your responsibilities and acceptable use
You agree not to use the Service to:
- submit, store, or transmit unlawful, infringing, malicious, or abusive content;
- collect data you have no lawful basis or permission to process, or special-category or children's data without the required legal basis and consents;
- circumvent the Service's privacy design — for example, by smuggling screenshots, device identifiers, or tracking data through feedback fields;
- interfere with, overload, or disrupt the Service, or bypass rate limits or access controls;
- introduce malware, or attempt to gain unauthorised access to the Service or other customers' data; or
- violate any applicable law or third-party right.
We may remove content or suspend access that we reasonably believe breaches this section.
6.Customer data and data protection
As between you and Feedi, you own your Feedback Data and you are the data controller for it; Feedi acts as your processor and handles Feedback Data only on your documented instructions to provide the Service. You are responsible for having a lawful basis to collect Feedback Data, for providing any required privacy notices to your End Users, and for obtaining any necessary consents.
Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf, that processing is governed by a data processing agreement; contact us to put one in place where you require it. You must not submit data through the Service that you are not permitted to process.
7.Third-party services
The Service may interoperate with third-party services you choose to connect, such as an issue tracker or a payment processor. Your use of those services is governed by their own terms, and we are not responsible for them. Enabling an integration authorises us to exchange the data needed to operate it on your behalf.
8.Fees, billing, and taxes
The Service offers a Starter plan and a paid Indie plan. Paid subscriptions are billed in advance through our payment processor on a recurring basis and renew automatically until cancelled. You can change your interval or cancel at any time, effective at the end of the current billing period.
Fees are exclusive of taxes, and you are responsible for any applicable VAT or sales taxes. Except where required by mandatory law, payments are non-refundable and we do not provide refunds or credits for partial periods. We may change pricing on reasonable prior notice; changes apply from your next renewal.
9.Early-product status and availability
Feedi is an early-stage product. Features may be experimental, may change, or may be withdrawn, and we do not guarantee any particular uptime, service level, or backwards compatibility unless separately agreed in writing. We may perform maintenance and may modify or discontinue parts of the Service; we will use reasonable efforts to give notice of material changes that affect you.
10.Intellectual property
Feedi, including the Service, software, SDKs, documentation, and brand, is owned by us and protected by intellectual-property laws. These Terms grant you no rights in our intellectual property other than the limited licence to use the Service. You retain ownership of your Feedback Data and Account Data.
11.Feedback you give us
If you send us suggestions or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or obligation to you.
12.Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED EUROS (€100).
Nothing in these Terms limits liability that cannot be limited by law, including liability for intent, gross negligence, or for injury to life, body, or health under mandatory German law. Your statutory rights as a consumer, where they apply, remain unaffected.
14.Indemnification
You will defend, indemnify, and hold harmless Feedi from and against any claims, damages, liabilities, and reasonable costs arising out of your Feedback Data, your application and its End Users, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
15.Term, suspension, and termination
These Terms apply while you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or create a security or legal risk, and we may suspend immediately where necessary to protect the Service or other customers.
On termination, your right to use the Service ends. We will make your data available for a reasonable export window where practical, after which it may be deleted. Provisions that by their nature should survive — including ownership, disclaimers, limitation of liability, and indemnification — survive termination.
16.Changes to the Service and these Terms
We may update these Terms from time to time. When changes are material, we will update the date below and, where appropriate, notify account holders by email. Continued use of the Service after an update means you accept the revised Terms; if you do not agree, stop using the Service.
17.Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages or actions of cloud, hosting, email, or payment providers, network failures, regulatory action, or events affecting a data-transfer mechanism we rely on.
18.Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the courts of Germany have exclusive jurisdiction over any dispute. Mandatory consumer-protection rules of your country of residence, where they apply, remain unaffected.
19.Dispute resolution
Before starting formal proceedings, please contact us at support@feedi.dev so we can try to resolve the matter directly. We are not obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
20.General
- Severability — if any provision is found unenforceable, the rest remains in effect.
- Entire agreement — these Terms, the Privacy Policy, and any data processing agreement form the entire agreement between us regarding the Service.
- Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Waiver — our failure to enforce a provision is not a waiver of it.
- Notices — we may give notice by email or by posting in the Service.
- No third-party beneficiaries — these Terms do not create rights for anyone other than you and us.
- Export and sanctions — you must comply with applicable export-control and sanctions laws when using the Service.
